For Kunming, political leaders intend to create the &#8222;<strong>Paris Moment<\/strong>&#8220; against the biodiversity crisis. It is thus now the moment to compare the compliance and implementation design of the draft text for biodiversity with the one for climate. To cut a long story short: In my opinion, the implementation mechanism and the overall legal approach to the future biodiversity agreement is doomed to fail. As my assessment will show, the chosen wording of the by now discussed text is timidly self-limiting and not built to deliver compliance.<\/p>\n<p>Some details (find the full assessment <a href=\"https:\/\/blogs.nabu.de\/naturschaetze-retten\/wp-content\/uploads\/sites\/3\/2021\/09\/2021-09-10_GBF-PA_Implementation-Failure.pdf\" target=\"_blank\" rel=\"noopener\">here<\/a>):<\/p>\n<ul>\n<li>It already starts with the <strong>title <\/strong>&#8211; why do parties name the future biodiversity agreement a &#8222;framework&#8220;, where no one understands what this means?<\/li>\n<li>Then, why is the <strong>purpose<\/strong> of the biodiversity agreement to (only) &#8222;galvanize&#8220; action, whereas the climate agreement makes it clear that parties must undertake certain action.<\/li>\n<li>Further reasons why the compliance design of the biodiversity agreement is doomed to fail: The <strong>non-binding architecture<\/strong> of the main commitments (action targets), <strong>no adequate tracking<\/strong> of success, nor a <strong>ratcheting-up<\/strong> once parties do not deliver.<\/li>\n<li>Finally, also the technical <strong>implementation mechanism<\/strong> itself does lack of substance (such as a compliance committee which exists with other international treaties).<\/li>\n<\/ul>\n<p>I am well aware that this assessment is harsh. It is a short and personal reflection that should primarily serve as a <strong>wake-up call<\/strong>. This text is drafted from a lawyer\u2019s perspective, looking at \u201c<strong>good regulation<\/strong>\u201d. This means to create provisions that deliver, not such that are doomed to failure. The legal basis to do better is provided by the CBD, which entitles parties at the COP to undertake any additional action required for the achievement of the purposes of the convention. The most sophisticated wording of the text, and respectively its goals, milestones and action targets will not help them being implemented. What is now needed is <strong>political will<\/strong> for an agreement that has binding nature, (quasi) enforceable targets and a robust compliance mechanism. It is not too late to improve, let\u2019s do it!<\/p>\n<p>&nbsp;<\/p>\n<h2>Zum Scheitern verurteilt: Die Umsetzungsarchitektur des Entwurfs des globalen Biodiversit\u00e4ts-Abkommens<\/h2>\n<p>Das globale Post-2020 Biodiversit\u00e4ts-Abkommen wird oft mit dem Pariser Klimaschutzabkommen verglichen. Die Politik m\u00f6chte in Kunming den &#8222;<strong>Paris Moment<\/strong>&#8220; gegen die Biodiversit\u00e4tskrise schaffen. Es ist daher angebracht, die Umsetzungs- und Vollzugsarchitektur des Entwurfs des Biodiversit\u00e4ts-Textes mit der des Klima-Textes zu vergleichen. Um es kurz zu machen: Meiner Meinung nach ist der Umsetzungsmechanismus und die rechtliche Herangehensweise an das zuk\u00fcnftige Biodiversit\u00e4tsabkommen bisher zum Scheitern verurteilt. Wie meine Analyse zeigen wird, sind die gew\u00e4hlten Formulierungen des bisher diskutierten Biodiversit\u00e4tstextes sch\u00fcchtern und nicht auf verbindliche Umsetzung ausgerichtet.<\/p>\n<p>Einige Details (<a href=\"https:\/\/blogs.nabu.de\/naturschaetze-retten\/wp-content\/uploads\/sites\/3\/2021\/09\/2021-09-10_GBF-PA_Implementation-Failure.pdf\" target=\"_blank\" rel=\"noopener\">hier<\/a> die volle Analyse):<\/p>\n<ul>\n<li>Es f\u00e4ngt schon mit dem <strong>Titel<\/strong> an &#8211; warum wird das zuk\u00fcnftige Biodiversit\u00e4ts-Abkommen &#8222;Framework&#8220; genannt, ein f\u00fcr jeden unverst\u00e4ndlicher Begriff?<\/li>\n<li>Dann, warum spricht der Text in der <strong>Zweckbestimmung<\/strong> so geschwollen davon, er wolle Handlungen &#8222;galvanisieren&#8220;, anstatt wie im Pariser Klimaschutzabkommen klarzumachen, dass der Text die Parteien zu konkreten Handlungen verpflichtet.<\/li>\n<li>Weitere Gr\u00fcnde, warum der Umsetzungsmechanismus des k\u00fcnftigen Biodiversit\u00e4tsabkommens zum scheitern verurteilt ist: die Hauptma\u00dfnahmen\/-ziele sind nicht in eine <strong>verbindliche Struktur<\/strong> eingebunden, und es fehlt an einem effektiven Mechanismus zur <strong>\u00dcberwachung<\/strong> der Zielerreichung sowie zur <strong>Nachsteuerung<\/strong>.<\/li>\n<li>Und schlie\u00dflich ist auch der technische <strong>Umsetzungsmechanismus<\/strong> inhaltsleer, beispielsweise mangelt es an einem Vollzugs-Gremium (das es bei anderen v\u00f6lkerrechtlichen Vertr\u00e4gen gibt).<\/li>\n<\/ul>\n<p>Mir ist bewusst dass dies eine harte Analyse ist. Es ist eine kurze pers\u00f6nliche Abhandlung, die haupts\u00e4chlich als <strong>Alarmruf<\/strong> dienen soll. Der Text ist aus der Sicht eines Rechtswissenschaftlers geschrieben, der &#8222;<strong>gute Gesetzgebung<\/strong>&#8220; im Blick hat. Gute Gesetzgebung bedeutet, Regeln zu schaffen, die effektiv liefern, nicht solche, die zum scheitern verurteilt sind. Die v\u00f6lkerrechtliche Grundlage hierf\u00fcr bietet die Biodiversit\u00e4tskonvention CBD, welche die Parteien erm\u00e4chtigt, alle n\u00f6tigen Schritte zu beschlie\u00dfen, um die Biodiversit\u00e4tskrise zu adressieren. Jede noch so ausgefeilte Formulierung des Textes bzw. seiner Ziele und Ma\u00dfnahmen werden nicht helfen, die Ma\u00dfnahmen auch umzusetzen. Was es jetzt braucht, ist <strong>politischer Wille<\/strong> f\u00fcr einen v\u00f6lkerrechtlich verbindlichen Vertrag mit (quasi) vollziehbaren Verpflichtungen und einem robusten Durchsetzungsmechanismus.
